                                                  JUDGMENT

Learned counsel appearing for the appellant submitted that the

dispute between the parties has been settled out of Court.

2. Learned counsel for the appellant sought permission of this Court

to withdraw the second appeal, and he has also made an endorsement to that

effect in the case bundle.

3. Recording the submission made by the learned counsel for the

appellant, this Second Appeal stands dismissed as withdrawn as the matter

is settled out of Court. No costs.

4. The Registry is directed to refund the Court fee to the learned

counsel for the appellant on proper verification.
