                                                           ORDER

(Order of the Court was made by J. Nisha Banu, J and R. Kalaimathi, J)

The Civil Miscellaneous Petition has been filed to condone the

delay of five days in filing the above Appeal Suit.

2. Today when the matter is taken up hearing, the learned counsel

appearing for the petitioner seeks permission of this Court to withdraw

this Civil Miscellaneous Petition. To that effect, he has made an

endorsement in the bundle.

3. Recording the submission and the endorsement made by the

learned counsel appearing for the petitioner, this Civil Miscellaneous

Petition is dismissed as withdrawn. Consequently, the Appeal Suit is

rejected at the SR stage itself. There shall be no order as to costs.
