Prayer: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 1st respondent to provide necessary police protection to the petitioner for extracting the gravel from the said land SF.No.130/3 situated at Alagappasamuthiram Village, Kadampulliyur SRO, Cuddalore District to an total extent of 5.03 Acres as stated in the schedule of the lease deed registered as Doc.No.1280/2020 on the file of SRO, Kadampulliyur to unload at Government site.

This Criminal Original Petition has been filed seeking police protection based on

the complaint given by the petitioner on 25.08.2023.

2.Learned Additional Public Prosecutor, on instructions, submitted that, based on

the complaint given by the petitioner, petition enquiry is pending in CSR.No.938 of

2023 on the file of the respondent Police.

3.The petitioner is directed to co-operate with the Police for enquiry and the

respondent Police shall conduct the enquiry keeping in mind the judgment in Lalitha

Kumari vs. Government of Uttar Pradesh reported in 2013 (6) CTC 353. On

completion of the enquiry, the respondent Police shall take a decision regarding the

further course of action. This process shall be completed by the respondent Police

within a period of two weeks from the date of receipt of copy of this order.

4.With the above directions, this Criminal Original Petition is closed.
