                                                      JUDGMENT

(Judgment of the Court was made by R.SUBRAMANIAN, J.)

The Original Petition in O.P.No.606 of 2022 has been filed under

Section 12(1)(c) of the Hindu Marriage Act, seeking a declaration that the

marriage is a nullity. The wife had claimed for interim maintenance at

Rs.18,000/- per month, contending that the husband is running a travel

agency in the name of TMS Thangavel Travels and earning about

Rs.60,000/- per month. The husband would deny the said allegation. He

would, however, admit that he is a driver and he has got a license with a

badge also.

2.The learned counsel for the appellant would contend that grant

of Rs.10,000/- is on the higher side. We have considered the submission of

the learned counsel for the appellant.

3.Considering the present day cost of living and the salaries that

are paid to drivers generally, we do not think, Rs.10,000/- could be said to

be excessive. On the facts and circumstances that are available on record,

we find that the grant of Rs.10,000/- per month need not be interfered with.

This Civil Miscellaneous Appeal therefore, fails and it is accordingly,

dismissed. No costs. Consequently, connected miscellaneous petition is

closed.
