                made in C.A. No. 92 of 2015 on the file of Learned I Additional District and
                Sessions Judge, Tiruppur which reversed the judgment dated 11.09.2015 made
                in C.C. No. 284 of 2013 on the file of the Learned Judicial Magistrate, Fast
                Track Court, Tiruppur and set aside the same.

                                                 JUDGMENT

Learned Counsel for the Respondent/Accused states that after the filing

of the Criminal Appeal, the Respondent/Accused has died and he has made an

endorsement to that effect in the court record.

In view of the same, the Criminal Appeal is dismissed as abated. It is

needless to clarify here that the Appellant is not precluded from pursuing his

available legal remedies for recovery of the amount due under the returned

cheque, which forms the subject-matter of the instant appeal from the legal

representatives of the deceased Respondent, by appropriate legal proceedings in

the manner recognized by law. No costs.
