                                                      JUDGMENT

This Civil Miscellaneous Appeal is pending from the year 2019 and

listed before me on 25.11.2022, 12.12.2022, 20.12.2022 and 23.01.2023. In

all the hearing dates, the learned counsel for the appellant was not ready for

arguments. On 23.01.2023, the case was adjourned under the caption 'for

arguments or for orders' and it was adjourned to 03.02.2023.

2.Today(03.02.2023), when the matter was listed and called upon, the

learned counsel for the appellant was not ready for arguments. The learned

counsel for the respondent was ready for arguments on all the hearing dates.

Hence, it is decided that there is no use in keeping the appeal pending any

further.
