When the matter was came up for hearing on 22.09.2022, it was

reported by the learned counsel for the appellants that the first appellant

died and he therefore, sought for time to take instructions.

2.When the matter was taken up today (i.e., 27.10.2022), a memo has

been filed along with a returned cover and the learned counsel for the

appellants reported no instructions.

3.In view of the above, this appeal is dismissed for non-prosecution.

No costs. Consequently, connected miscellaneous petition is also closed.
