It is stated that Mr.M.N.Radhakrishnan, who had filed the

appeal suit as a President of Manicka R.M.Sankaranarayana Iyer

Annadhana Dharma Fund, is no more.

2. The learned counsel for the appellant would submit that he

has not got instructions from the legal heirs. A memo has also been filed.

3. Recording the same, the appeal suit is dismissed as having

abated. No costs. Consequently, connected Miscellaneous Petition is

closed.
