(The Judgment of the Court was delivered by The Honourable Chief Justice)

Learned counsel for the appellant prays for withdrawal of the Writ Appeal,

with liberty to approach the respondents to consider his representation for

acceptance of the rent after construction of the superstructure and even execute

the gift deed as per the condition, which may appropriately be considered by the

Hindu Religious and Charitable Endowments Department (H.R & C.E) and the

representation for that would be given within a period of ten days and

thereupon, it would be considered by the H.R. and C.E Department, within a

month. With these observations, the Writ Appeal is dismissed as withdrawn.

There shall be no order as to costs. Consequently, C.M.P. is closed.
