                                                          JUDGMENT

This Second Appeal is filed against the judgment and decree passed

in A.S. No.25 of 2009 dated 10.06.2011 on the file of the Sub Court,

Uthamapalayam in reversing the judgment and decree dated 21.04.2009

passed in O.S. No.189 of 2006 on the file of the District Munsif Court,

Uthamapalayam.

2. Today, when the matter is taken up for hearing, the learned counsel

for the appellant would submit that the appellant died on 26.03.2017 and the

legal heirs of the deceased/appellant is not yet impleaded.

3. In view of the same, the Second Appeal is dismissed as abated. No

costs. Consequently connected miscellaneous petition is closed.
