                                                      JUDGMENT

The learned counsel appearing for the appellant circulated a letter

dated 23.09.2021 to the Registry enclosing a letter of the appellant dated

09.09.2021, for listing this matter for withdrawal as the parties have arrived at a

partition as per decree passed by the Subordinate Court, Gobichettipalayam.

Accordingly, the matter is listed today under the caption “for withdrawal”.

2. Today when the matter is taken up, the learned counsel for the

appellants seeks permission of this Court to withdraw the Second Appeal.

Recording the submission made by the learned counsel for the

appellant and the letter dated 23.09.2021, the Second Appeal is dismissed as

withdrawn. There shall be no order as to costs. Consequently, connected

Miscellaneous Petition is closed.
