This matter is listed under the caption for dismissal today. There is

no representation on the side of the Appellant. Learned counsel for the

first respondent would submit that till date she has not received copies of

papers from the Appellant's counsel. Even on the last hearing date, i.e.,

on 13.09.2021, there was no representation on the side of the Appellant.

It can now be inferred that the Appellant is not interested in prosecuting

this Appeal. Accordingly, this Civil Miscellaneous Appeal is dismissed

for non prosecution. No costs. Consequently, connected miscellaneous

petition is closed.
