representation on behalf of the appellant and hence, the matter was directed to

be listed under the caption “for dismissal” on 22.10.2021 and the matter is

listed today. Even on 25.10.2021 (today) also, there is no representation on

behalf of the appellant.

3.Accordingly, this First Appeal is dismissed for non-prosecution. No

costs. Consequently, the connected civil miscellaneous petition is also closed.
