                                   Writ Petition is filed under Article 226 of the Constitution of
                     India, praying for the issuance of a Writ of Certiorari, calling for the records
                     of      the   second   respondent,    relating      to   the   proceedings   bearing
                     Na.Ka.93/A/A.A5/2016 dated 31.03.2016 and quash the same.

                                                       ORDER

The Managing Director of Tamil Nadu Urban Habitat

Development Board communicated a letter dated 05.10.2021 to the learned

counsel appearing on behalf of the respondents stating that “when the Board

officials conducted an inspection on 04.10.2021, it is found that

Mr.Jaganathan has been residing in the tenement and he visits his elder

son's house regularly. Since, the O.S. was dismissed and Mr.Jaganathan was

residing in the tenement continuously, the 'B' notice which was issued

earlier was not implemented and his requisition may be considered after the

completion of reconstruction and based on the judgment passed in the Writ

Petition”.

2. In view of he abovesaid instructions, the order impugned

passed by the second respondent in proceedings bearing Na.Ka.93/A/

A.A5/2016 dated 31.03.2016 stands quashed.

3. Accordingly, the writ petition stands allowed. However,

there shall be no order as to costs. Consequently, connected miscellaneous

petition is closed.
