                                                      JUDGMENT

This Civil Miscellaneous Appeal is filed against the judgment and

decree, dated 04.09.2008, passed in M.C.O.P.No.98 of 2006, on the file of the

Motor Accident Claim Tribunal (Sub Court), Kovilpatti.

2. When the matter is taken up for hearing today (07.10.2021), it is

stated that already an appeal against the same award in C.M.A.(MD)No.1342 of

2012, filed by the claimant, was disposed of by this Court, on

22.02.2013 itself.

3. A perusal of the records reveals that the parties are the same in the

Appeal, in C.M.A.(MD)No.1342 of 2012 is against the award in M.C.O.P.No.

98 of 2006, dated 04.09.2009. To avoid contradictory orders and on request of

both side counsel, this Civil Miscellaneous Appeal is closed. No costs.

Consequently, connected Miscellaneous Petition is closed.
