                                                       JUDGMENT

It is seen that the sole appellant has died long back and despite

sufficient opportunities given, no steps have been taken to implead the

legal representatives of the deceased appellant as per law and prosecute

the matter further. In such view of the matter, there is no purpose in

keeping the appeal further pending.

2. In the light of the abovesaid factors, the second appeal is

dismissed as abated. No costs. Consequently, connected miscellaneous

petition is closed.
