“On the last occasion the learned counsel for the appellant had submitted that the parties had settled the matter and that he was withdrawing the Second Appeal, for which he sought time to file a memo. No memo has been filed and neither is there any appearance both on the side of the appellant as well as the respondent. Post the matter under the caption “For Dismissal” on 25.06.2021.”

2.Even though, the matter is listed today under the caption 'for

dismissal', neither the appellant nor his counsel is present to prosecute the

matter. Considering the above, the Second Appeal stands dismissed for non

prosecution. No costs.
