                     Prayer: The Second Appeal is filed under Section 100 of the Code of Civil

                     Procedure, seeking to set aside the Decree and Judgement, dated 10.11.2008

                     passed in A.S.No.52 of 2008 passed by the VII Additional District Judge,

                     Madras, confirming the decree passed in O.S.No.6117 of 2006 dated

                     31.01.2007 on the file of the learned XII Assistant Judge, City Civil Court,

                     Chennai.

                                                    JUDGMENT

Today, when the Second Appeal is taken up for hearing, it is

represented by Mr.Gowrishankar, learned counsel appearing for

appellant and the respondent has become infructuous and hence he seeks

permission of this Court to withdraw the Second Appeal.
