                                                       JUDGMENT

Today, when the Second Appeal is taken up for hearing, there was

no representation on behalf of the appellants. The learned counsel

appearing for the 1st respondent alone appeared before this Court, through

Video Conferencing.

2. On verification of records, it appears that after filing the appeal

in the year 2007, so far, steps have not been taken for serving summons to

the 2nd respondent. Further, the counsel for the appellants regularly not

appearing to represent the Second Appeal.

3. Hence, in view of the above, the Second Appeal is dismissed

for default. No costs. Consequently, connected miscellaneous petition is

closed.
