115 of C.P.C., to set aside the Judgment and Decree passed in
fair and decreetal order passed in E.P.No.29 of 2019 in
M.C.O.P.No.71 of 2014 dated 19.04.2021 on the file of the Sub
Court, Padmanabhapuram and allow the civil revision petition.

ORDER
This civil revision petition is directed against the
order passed by the executing Court for enforcing the award
passed by the Motor Accidents Claims Tribunal in M.C.O.P.
No.71 of 2014.
2. The learned Special Government Pleader points out
that the award will be satisfied and only due to the current
pandemic situation, they are not able to satisfy the award. He
would also point out that the Deputy Registrar of the
Co-operative Societies is not possessed with requisite funds
also.
3. I made it clear that unless some definite
commitment is given as regards the settlement of the award
amount, I will not be inclined to entertain this civil revision
petition.
4. In these circumstances, the learned Special
Government Pleader submitted that within a period of four
months, the award amount will be deposited. The said
submission is recorded.

5. The executing Court is directed to keep the
impugned order in abeyance for a period of four more months.
This civil revision petition is disposed. No costs. Consequently,
connected Miscellaneous petition is closed.
