                                                      ORDER

This Miscellaneous Petition is filed to condone the delay of 83

days in preferring the appeal against the judgment dated 31.07.2014 in

O.A(II-U) No.128/2013 passed by the Railways Claims Tribunal,

Madras Bench.

2. This Court passed an order on 13.07.2015 ordering notice to

the respondent returnable in four weeks and private notice was also

permitted. The matter is pending for the past about five years. Till today,

the petitioner has not served notice to the respondents. In view of the

fact that notice has not been served to the respondent for the past about

five years, this Court is not inclined to keep the matter pending further.

Accordingly, the Miscellaneous Petition stands dismissed and

consequently, C.M.A.SR.No.5186 of 2015 stands rejected at the SR

stage itself. No costs.
