Today when the appeal is taken up for hearing, there is no

representation on the side of the appellant.

2. It is seen that the suit is of the year 1994 and the Second

Appeal has been filed in the year 2000. As the Appeal has been pending

from the year 2000 and the appellant has not shown any interest in

prosecuting the matter further, this Court is inclined to dismiss this

appeal.

3. In view of the above, this second appeal is dismissed. No

costs. Consequently, connected miscellaneous petition is also dismissed.
