                      the petitioner in partly disallowed in RCA No. 810/98 dated

                      20.05.2003.

                                                   JUDGMENT

When the matter was taken up for hearing on 09.02.2021,

there was no representation on behalf of the appellant and

therefore, the matter was directed to be listed under the caption

'for dismissal' on 11.02.2021.

2.When the matter was again taken up for hearing on

24.02.2021, there was no representation on behalf of the appellant

and this Court directed the Registry to list the matter under the

caption 'for dismissal' on 26.02.2021.

3. When the matter is listed today, i.e., on 26.02.2021, there

is no representation on behalf of the appellant. Thus, it is evident

that the appellant is not inclined to pursue the case and,

accordingly, the civil miscellaneous second appeal is dismissed for

non-prosecution. No costs.
