                     confirming the judgment and decree dated 29.02.2016 in O.S.No.9 of 2014
                     passed by the learned District Munsif Court, Ranipet, Vellore District.

                                                       JUDGMENT

This matter was originally came up for hearing on 27.01.2021

before me. On that day, there was no representation for the appellant https://www.mhc.tn.gov.in/judis/

S.A. No.268 of 2018, dt.19.02.2021

neither in person nor through counsel, therefore, the matter was directed to

be listed on 10.02.2021. Accordingly, the matter was listed on 10.02.2021,

even that day, none appeared for the appellant. Therefore, this Court

directed the Registry to list the case under the caption for dismissal on

19.02.2021.

2.Even today, when the matter is called, none appeared on behalf

of the appellant, though the case is listed under the caption “for dismissal”.

It shows the appellant is not interested to prosecute the case. Accordingly,

the Second Appeal is dismissed as non prosecution. No costs.

Consequently, the connected miscellaneous petition is closed.
