                                                      JUDGMENT

The learned counsel for the appellant submitted that this appeal has been

filed challenging the judgment and decree passed by the Courts below. The suit

has been filed for partition and the appellant is also entitled for his share.

However, since the appellant aggrieved by the decision of the Courts below, he

has filed this present appeal.

2.The learned counsel for the appellant submitted that the appellant was

passed away on 20.10.2018 and so far, the legal heirs of the appellant have not

taken any steps to implead them.

3.Recording the submission made by the learned counsel for the

appellant, this Second Appeal is dismissed as abated. No costs. Consequently,

connected miscellaneous petition is closed.
