2. Memo has been filed by the appellant's counsel informing

that nothing further survives in the second appeal for the reasons

mentioned in the memo and accordingly prays to close the second appeal

as infructuous based on the memo. The memo is taken on record.

3. In the light of the abovesaid factors, considering the reasons

furnished in the memo filed by the appellant's counsel, as the second

appeal has become infructuous, nothing further survives in the second

appeal, accordingly, recording the memo filed by the appellant's counsel

in the second appeal, the Second Appeal is dismissed as infructuous. No

costs. Consequently, connected miscellaneous petition, if any, is

closed.
