                     Procedure Code, against the judgment and decree dated 05.12.2001 made
                     in A.S.No.174 of 2000 on the file of the II Additional Sub Court,
                     Madurai is confirming the judgment and decree, dated 30.06.2000 made
                     in O.S.No.3 of 1999 and deecretal order in I.A.No.387 of 1999 on the file
                     of the District Munsif, Melur.

                                                           JUDGMENT

The learned counsel for the appellant submits that the sole

appellant had passed away on 31.01.2005. The legal heirs of the sole

appellant have not responded to implead themselves as legal heirs to

prosecute this appeal. Hence, this Second Appeal is dismissed as abated.

No costs. Consequently connected miscellaneous petition is closed.
