Mr.Dr.S.S.Swaminathan, learned counsel for the appellant submits

that this Civil Miscellaneous Appeal may be dismissed as infructuous in

the light of the order passed by the Division Bench of this Court in

C.M.A.No.595 of 2019 on 30.03.2021. The respondent/claimant had

filed an appeal in the impugned judgment and decree dated 06.09.2018

passed in M.C.O.P.No.224 of 2014 by the Chief Judicial Magistrate,

Motor Accident Claim Tribunal, Vellore and further submits that nothing

survives for further adjudication in this appeal.

2.Recording the same, this Civil Miscellaneous Appeal is

dismissed as infructuous. No costs. Consequently, connected Civil

Miscellaneous Petition is closed.
