                                                          JUDGMENT

[Judgment of the Court was made by T. S. SIVAGNANAM, J.,]

This Writ Appeal by the Writ Petitioner is directed against the

order dated 28.01.2019, passed in W.P.(MD)No.24948 of 2018.

2. The legal issue involved in this appeal was the subject matter of

reference to the Honourable Full Bench in the case of District Collector,

Sivagangai District Vs. N.Udayappan, [W.A.(MD)Nos.281 and 331 of

2019, dated 17.03.2021].

3. It is not in dispute that in the light of the decision of the Hon'ble

Full Bench, more particularly, the finding rendered in paragraph 61(7),

the appeal has to be necessarily dismissed.

4. In the light of the same, this Writ Appeal fails and accordingly,

the same is dismissed. No costs. Consequently, connected miscellaneous

petition is closed.
