                                                                  ORDER

This is seventh bail application filed by the applicants under Section 483 of the Bharatiya Nagrik Suraksha Sanhita , 2023 for grant of regular bail relating to FIR/Crime No.30/2024 registered at Police Station - Chargawan, district - Jabalpur for the offences punishable under Sections 498A, 323, 294, 304B and 34 of the IPC. The applicants are in custody since 25.02.2024.

2. As per prosecution case, on 22.01.2024 at around 10:30 am, the

deceased was doing household works when her husband Bunty, and her mother-in-law and father-in-law abused her and beat her up for cooking food late. Fed up with such abusing her everyday, taunting her about her parents' death and beating her up by the accused persons, the victim consumed poisonous substance on 22.01.2024 and during treatment, the victim died on 15.02.2024 at Medical College Jabalpur. 2 MCRC-3461-2026 against the applicants, they were sent to jail.

3. Learned counsel for the applicant submits that in earlier application M.Cr.C. No.49871/2025 vide order dated 17.11.2025, this Court granted liberty to renew the prayer for bail after two months and therefore, the present application has been filed. The present applicants are father-in- law and mother-in-law of the deceased and there is no specific allegations against them. Charge-sheet has been filed. It is further contended that treating doctor has deposed in his examination that he has recorded initial history from the patient and on perusal of the history, only the name of husband was mentioned by the deceased. Therefore, it is contended that the present applicants who are father -in -law and mother-in-law of the deceased, have been falsely implicated. It is also contended that in the postmortem report of

the deceased, no injury was found on her body and there is no whisper of demand of dowry from the FIR or other materials. The present applicants are in custody since 25.02.2024 i.e. about 2 years and, the trial would take considerable time to conclude, therefore, the applicant be released on bail.

4. The counsel for the State has opposed the application by submitting that there is dying declaration wherein the names of the present applicants have been mentioned for harassing the deceased.

5. Heard the submissions and perused the case diary.

6. Considering the fact that applicants are old age father-in-law and mother-in-law; as per statement of treating doctor, the deceased had not named the present applicants; the applicants are in custody since 25.02.2024 and the trial has not yet substantially progressed, therefore, without

3 MCRC-3461-2026 expressing any opinion on merits of the case, I deem it to be a fit case to release the applicants on bail. Therefore, the application is allowed.

It is directed that the applicants shall be released on bail on their furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) each with one surety each in the like amount to the satisfaction of the trial Court concerned for their appearance before the said Court on all such dates as may be fixed by that Court in this regard during the pendency of trial

8. It is further directed that the applicants shall comply with the provisions of Section 480(3) of the Bharatiya Nagrik Suraksha Sanhita, 2 023.
