                                                                  ORDER

Present petition is filed by the petitioners under Article 226 of Constitution of India by challenging the order dated 27.06.2024 (Annexure P/1) passed by respondent No.4 Maharshi Patanjali Sanskrit Sansthan,

Bhopal and seeking following reliefs :-

"(a) Issue a writ of mandamus to direct the respondents to continue the operation of the Admission Policy 2018(Annexure P-

3) in the matter of admission to Class X and XII in the schools affiliated to MPSS (Maharshi Patanjali Sanskrit Sansthan, Bhopal) like the petitioners.

(b) To issue a writ in the nature of certiorari, or the like to quash Annexure P-1 dated 27.06.2024 passed by respondent no. 4 MPSS (Maharshi Patanjali Sanskrit Sansthan, Bhopal).

(c) To Pass any other order(s) as this Hon'ble Court may deem fit in the interest of justice."

Learned counsel for the petitioners submits that the impugned order dated 27.06.2024 (Annexure P/1) bars admission of students in Maharshi Patanjali Sanskrit Sansthan, Bhopal who have not done Class 9th and 11th from same Board or school. It is submitted by counsel appearing for petitioners that students of CBSE and other Boards will deprive from taking

admission in Sanskrit School due to said amendment in the policy. It is submitted that many students are not being permitted to fill up the forms.

Learned counsel for the respondents/Sanstha has objected the said prayer by submitted that though the petition is filed in August, 2025, the petitioners have not filed any application for interim relief on earlier occasion and now the process is already initiated for filling-up the forms etc. for other students it is too late to consider such prayer made by the petitioners, which otherwise, also create disturbance in the admission for holding such examination as the same are already completed or under way of completion.

4. I have considered the rival submissions made at the Bar.

5. Considering the submissions of counsel for the respondents that though there is no specific mention about how many students are affected but as per his submission total 11 schools and considering two classes of Xth and XIIth

3 WP-34680-2025 the standard and considering average students in each class probably by way of this future of approximately i.e 1000 students is involved in the subject matter of the present petition. Therefore, considering the submission, court is of the view that the impugned order 27.06.2024 is required to be stayed and students studying in schools be permitted fill-up the form within 04 days from tomorrow and all necessary required documents will be verified by the respondent/Sanstha within further four days, thereafter students shall pay examination fees within four days therefrom. After completing and clearing all necessary formalities, as indicated in this order as well as required in the rules, respondent shall permit them to appear in the examination by issuing Admit Card in accordance with the rules.

It is clarified that respondent/authority will not insist anything on the count of the last date for submitting the form is already over and now process is required to be carried out as per the above mentioned direction limited to the extent of students who are connected with the subject matter of the present petition of 11 schools. It is further made clear that this court has considered the matter considering the larger interest of students and considering peculiar facts of the present case.

7. With the aforesaid direction, petition is disposed off.
