On due consideration, I.A. No.12171/2025 - an application for urgent hearing during summer vacation is allowed and the matter is taken up for hearing.
Heard on the question of admission.
Revision is admitted for final hearing.
Also heard on I.A. No.8038/2025 which is first application for suspension of sentence on behalf of applicants.
This criminal revision assails the judgment dated 12.03.2025 passed in Criminal Appeal No.04/2025 and Criminal Appeal No.08/2025 by II Additional Sessions Judge, Panna (M.P.) whereby applicants have been convicted for offence punishable under Section 457 and 380 of IPC and sentenced to suffer R.I. for 03 years and fine of Rs.1000/- and R.I. for 02
years and fine of Rs.1000/- respectively with default stipulation.
Learned counsel for the applicants submits that the learned Courts below have erred in law in convicting and sentencing the applicants. Further, the applicants have already undergone jail sentence of 09 months including the custody period during trial. Final disposal of the revision will take time. On these grounds, learned counsel has prayed for suspension of execution of
2 CRR-1506-2025 jail sentence and grant of bail.
Per contra, counsel for the State has vehemently opposed the application and prayed for dismissal of the application pointing out the fact that there is recovery of articles from the possession of applicants and they have been identified in test identification parade.
Considering the overall facts and circumstances of the case as well as the fact that out of three years jail sentence, they have already undergone 09 months jail sentence and looking to the fact that there is no likelihood of early disposal of the revision in near future, this Court is inclined to grant bail to applicants by way of suspension of sentence.
Accordingly, without expressing any opinion on the merits, I.A. No.8038/2025 is allowed and it is directed that the remaining jail sentence of
the applicants, namely, Anil Singh, Mohan Singh and Rahul Singh shall remain suspended on the applicants furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand only) each with separate solvent surety in the like amount each to the satisfaction of Trial Court concerned for their appearance before the Trial Court concerned on 25/09/2025 and thereafter on such other dates as may directed by the Trial Court in this regard.
List the matter for final hearing in due course. Certified copy as per rules.
