This petition under Article 227 of the Constitution of India is against an order dated 11.09.2023 passed by the Additional Collector, Rewa.

Learned counsel for the petitioners was put a specific question thrice to point out as to how the present petition is maintainable in view of the judgment passed by a coordinate Bench of this Court in the case of Hiralal vs. Lakshmibai and others (M.P. No.3857 of 2022) dated 19.10.2023, there is no answer to the same. However, learned counsel for the petitioner has

argued on the merits of the matter.

The fact remains that against an order passed by the revenue authority, a misc. petition under Article 227 of the Constitution of India is not maintainable. Under these circumstances, this Court refrains from entertaining the present petition under Article 227 of the Constitution of India being not maintainable in view of the judgment passed by the Coordinate Bench in the case of Hiralal (supra). Accordingly, this misc.

NEUTRAL CITATION NO. 2025:MPHC-JBP:7733

2 MP-5983-2023 petition stands dismissed.

The petitioners are always at liberty to file a writ petition under Article 226 of the Constitution of India challenging the impugned order.
