                                  Heard on IA No.9378/2025 , which is first application under section
                           430 of the BNSS, 2023 seeking suspension of sentence on behalf of
                           appellant no.1 Sanjay@Sanju Malviya, who has been convicted under

                           sections 326 and 323/34 of the IPC and sentenced to undergo 5 years RI and
                           1 year SI with fine of Rs.5,000/- and Rs.500/- with default stipulations of 3
                           months RI and 1 month RI vide judgment dated                    22.01.2025 in ST
                           No.36/2022 by Second Additional Sessions Judge, Dewas (M.P.)
                                  Counsel for the appellant submits that appellant is innocent and he has
                           falsely been implicated in the aforementioned crime. This appeal is of the
                           year 2025 and its final disposal would take considerable long time to
                           conclude. Hence, in such circumstances, prayer is made to enlarge the
                           appellant on bail.

                                  Counsel for the respondent/State opposed the application and prayed

for its rejection.

Considering the para-7 and 10 of the statement of victim (PW-2) and the facts and circumstances of the case, the arguments advanced by the counsel for the parties coupled with the fact that the sentence is of limited period, without commenting on the merit of the case, the application is

2 CRA-2009-2025 allowed and it is directed that the execution of remaining jail sentence passed against the appellant no.1 Sanjay@Sanju Malviya shall remain suspended subject to his depositing the fine amount (if already not deposited) and furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the trial court for his appearance before the Registry of this Court on 19.11.2025 and on such further dates as may be fixed in this behalf by the Registry during the pendency of this appeal.
