Revision petition has already been admitted for final hearing.

2. Record of both the Courts have been received.

3. Heard on I.A. No. 5281 of 2024, which is an application for grant of

bail to the applicant during the pendency of the present revision.

4. It is contended by the counsel for the applicant that applicant has been tried under Sections 325 and 323 of IPC and he has been convicted only under section 325 of IPC and sentenced to suffer rigorous imprisonment of 1 year and fine of Rs.1000/-. It is contended by learned counsel for the applicant that the applicant is in jail since the date of judgment of the Appellate Court dated 22.02.2024. He has submitted that the maximum sentence awarded to the applicant is only 1 year under section 325 of IPC. It is further argued by the counsel for the applicant that final hearing of revision will take quite some time.

Hence, the applicant should be given benefits of suspension of sentence and grant of bail. Even in the first week of may, 2024, the revision could not reach for final hearing as it was listed on serial no.161.

5. Learned Panel Lawyer for the respondent/State opposed the prayer for suspension of sentence.

6. Heard learned counsel for the parties.

7. Looking to the short sentence awarded to the applicant and the weak possibility of final hearing of revision in near future, I.A. No. 5281/2024 is

2 CRR-943-2024 allowed. It is directed that jail sentence of applicant Ram Kishore shall remain suspended during the pendency of this revision and he shall be released on bail, subject to depositing the entire fine amount, if already not deposited, and on furnishing personal bond in the sum of Rs. 30,000/- (Rs. Thirty Thousand Only) with one solvent surety of the like amount to the satisfaction of the trial Court, for their appearance before the trial Court on 22.07.2024 and on other dates as may be fixed in this regard by that Court till final disposal of this revision.
