Citation : 2024 Latest Caselaw 4055 MP
Judgement Date : 12 February, 2024

Madhya Pradesh High Court

Radheshyam vs The State Of Madhya Pradesh on 12 February, 2024

Author: Maninder S. Bhatti

Bench: Maninder S. Bhatti

IN THE HIGH COURT OF MADHYA PRADESH AT JABALPUR CRR No. 524 of 2024 (RADHESHYAM AND OTHERS Vs THE STATE OF MADHYA PRADESH)

Dated : 12-02-2024 Anuj Singh - Advocate for the applicants.

Ms. Arti Dwivedi - Panel Lawyer for the State.

Heard on the question of admission.

Perused the impugned judgment.

The revision appears to be arguable, therefore, it is admitted for final

hearing.

Also heard on I.A. No.3095/2024, which is an application for suspension of sentence and grant of bail to the applicant.

This revision is against the judgment dated 27/01/2024 passed in Cr.A. No.20/2023 by Additional Sessions Judge, Berasiya, district Bhopal whereby the order passed by the trial Court on 24.4.2023 has been affirmed convicting the applicants for the offence punishable under Sections 332 and 34 of the Indian Penal Code and sentenced thereunder to suffer R.I. for 1 year with a fine of Rs.1000/- on each count with default stipulation.

Learned counsel for the applicants submits that the applicants are in jail. He further submits that the applicants are ready to abide by the conditions imposed by the Court, if bail is granted to them. He further submits that the final hearing of the revision will take a long time and if the applicants remain in jail, the purpose of filing this revision would be frustrated.

On the other hand, learned Government Advocate has opposed the prayer of bail.

Considering the arguments advanced by learned counsel for the parties, I

a m inclined to consider and allow the application. Accordingly, I.A. No.3095/2024 is allowed.

It is directed that on applicants' depositing the entire fine amount, if not deposited, their remaining jail sentence shall remain suspended and they shall be released on bail upon their furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each with a surety bond of like amount to the satisfaction of trial Court concerned for their appearance before the trial Court on 28.5.2024 and on such other dates as may be fixed by it in this regard.

List in due course for final hearing.

Certified copy as per rules.

(MANINDER S. BHATTI) JUDGE
