Perused the impugned judgment.

Appeal involves arguable points, hence admitted for final hearing.

Let record of the trial Court be called for. Also heard on I.A. Nos.2441/2024, 2442/2024, 2443/2024, 2444/2024, 2445/2024, 2447/2024 and 2448/2024 which are the first applications for suspension of sentence and grant of bail to the appellants.

Vide impugned judgment dated 23.12.2023 passed by 22 nd Additional Sessions Judge and Special Judge (MP/MLA) Indore, appellant Nos.1 to 3 have been convicted under Sections 120-B of the IPC and Section 13(1)(D) read with Section 13(2) of the PC Act and sentenced to undergo RI for one year on each count with fine of Rs.1000/- and Rs.2000/- respectively with default

stipulations whereas appellant Nos.4 to 7 have been convicted under Sections 120-B and 420 of the IPC and sentenced to undergo RI for one year on each count with fine of Rs.1000/- and Rs.2000/- respectively with default stipulations.

Learned counsel for the appellants submits that the sentence awarded to the appellants is of short term. He has further submitted that the trial Court has already suspended the jail sentence of appellants till 20.02.2024. Therefore, remaining jail sentence of the appellants may be suspended and they may be

enlarged on bail.

Considering the aforesaid, I.A. Nos.2441/2024, 2442/2024, 2443/2024, 2444/2024, 2445/2024, 2447/2024 and 2448/2024 are allowed.

I t is directed that remaining jail sentence of appellants shall remain suspended and they shall be released on bail subject to their depositing the amount of fine, if not already deposited, and on their furnishing a personal bond in the sum of Rs.50,000/- each with a surety bond of like amount each to the satisfaction of the trial Court concerned for their appearance before the Registry of this Court on 22.04.2024 and on such other dates as may be fixed in this regard.

List this appeal for final hearing in due course along with Cr.A. No.125 of 2024.
