Heard on I.A. No.15157 of 2023 for condonation of delay. It is seen from the record that vide order dated 14.12.2022, this Court

has already condoned delay of 58 days in filing this appeal preferred by the State against the impugned judgment.

Learned counsel for acquitted respondent No.3 prays for withdrawal of I.A. No.21196 of 2023 an application for dismissal of the instant appeal for being barred by limitation.

Accordingly, I.A. No.21196 of 2023 stands dismissed as withdrawn. At this juncture, learned counsel for the State prays for short adjournment to prepare the case to argue on the question of leave to appeal.
