Heard on the question of admission. Appeal being arguable is admitted for final hearing on the following substantial questions of law :-
1. Whether on the facts and in the circumstances of the case learned courts below have erred in decreeing the suit ?
2. Whether on the basis of material available on record the suit filed by the plaintiff is barred by limitation ?
Also heard on I.A. No.16874/2015, which is an application under Order 41 Rule 5 CPC.
Learned counsel for the respondents prays for and is granted four weeks' time to file reply to the I.A. No.16874/2015.
List the case after four weeks.
In the meantime effect, operation and execution of the judgment and decree dated 30.07.2014 passed by the trial court shall remain stayed.
