Heard on I.A.No.20082 of 2022 which is an application for suspension of sentence and grant of bail filed on behalf of the appellant.
The appellant is aggrieved by the judgment of conviction and sentence imposed upon him by the learned trial Court where he has been convicted for the offences under Section 13 (1) (c) & (d) read with Section 13 (2) of the Prevention of Corruption Act, 1988 alongwith collateral sections of Indian Penal Code.
Learned counsel for the appellant has shown from the cause title of the trial Court judgment that the appellant is 85 years of age and has been sentenced to suffer of 5 years R.I. by the learned trial Court.
Under the circumstances, looking to the advance age of the appellant,
I.A.No.20082/2022 is allowed. The sentence stands suspended. It is directed that the appellant shall be enlarged on bail upon his furnishing a personal bond in the sum of Rs.30,000/- (Rs. Thirty Thousand Only) with one surety in the like amount to the satisfaction of the learned trial Court.
I.A.No.20082/2022 is disposed of.
Record of the lower Court has already been received. The appeal has already been admitted for final hearing vide order dated 11.11.2022.
Under the circumstances, list in due course. C.C. as per rules.
