I.A.No.474/2023 is an application for permission to initiate contempt proceeding against newly added respondent as Sunil Pardhi.

I t is submission of counsel for the petitioner that in the judgment and

decree passed by the Courts below respondent no.2 Sunil Pardhi was not party respondent as respondent/defendant. Vide order dated 09.12.2019, an injunction has been granted by the co-ordinate Bench but respondent no.2 caused violation of the said injunction order willfully. Therefore, he has been added as party respondent.

Office objection was raised and, therefore, this application has been preferred to clarify the fact that respondent no.2 was also instrumental in flouting the order willfully.

O n due consideration, application is allowed and petitioner is permitted

to prosecute the respondent no.2 for alleged non-compliance of order dated 09.12.2019 in deliberate and willful manner.

Issue notice to the respondents on payment of process fee within a period of seven days by Registered A.D. mode, returnable within two weeks.
