This third application under Section 439 of Cr.P.C. has been
filed for grant of bail. The second application was dismissed by order
dated 21/3/2022 passed in M.Cr.C. No.13207/2022.
The applicant has been arrested on 6/1/2022 in connection with
Crime No.257/2021 registered at Police Station Khaniyadhana,
District Shivpuri for offence under Sections 379, 414 of IPC read
with Section 4/21 of the Minor Minerals Act.
The first bail application of the applicant was withdrawn after
realizing that the Court is not going to pass a favourable order. The
applicant is in jail from 6/1/2022 and has not undergone the
reasonable period of detention. Accordingly, in the light of the
judgment passed by the Supreme Court in the case of Jayant and
others Vs. State of M.P. reported in (2021) 2 SCC 670, the
application fails and is hereby dismissed.
