With the consent of both the parties by filing this instant petition. The petitioner has challenged the legality and proprietary of the order

dated 24.07.2018 (Annexure P/11), whereby the respondents were obliged to decide the claim of the petitioner for grant of compassionate appointment in the light of order dated 08.04.2017 passed in W.P. No.12336/2014, taking into consideration the judgment passed by this Court in the case of Narendra Singh Umath Vs. State of M.P. & Ors. 2012(4) M.P.H.T. 95.

Learned counsel for the petitioner submitted that though in the Lok Adalat, the respondents have agreed to reconsider the claim in the light of Narendra Singh Umath (supra) but no decision whatsoever has been taken in the matter. According to Annexure P/11 dated 24.07.2018 opinion was to be

sought from the Government counsel for further action but that has also not taken till date. In such circumstances, the petitioner is being made to run from pillar to post seeking compassionate appointment. Admittedly there is no order of reconsideration in the light of Narendra Singh Umath (supra). The return filed by the respondent is silent on the aspect as to whether any decision has been taken in view of undertaking given by the respondents before the Lok Adalat.

Accordingly, the respondent/State is directed to consider the claim of the petitioner for grant of compassionate appointment in the light of Narendra Singh Umath (supra) as expeditiously as possible within a period of two months from the date of receipt of certified copy of the order and passed a Signature Not Verified SAN reasoned and speaking order. This Court has not expressed any opinion on
