Learned counsel for the petitioner places reliance on the Division Bench decision in the matter of Umesh Kumar Bohare Vs. State of Madhya Pradesh and Others, dated 03.06.2019 and he submits that the impugned action in the present
writ petition has been taken in exercise of the power conferred under Rule 15A of the Madhya Pradesh Nagar Palika (Registration of Coloniser, Terms and Condition) Rules, 1998. According to him, in view of the aforesaid legal position, the impugned action in the instant writ petition deserves to be set aside.
Learned counsel for the State, however, submits that if a short time is granted to him, he will go through the aforesaid judgment and assist the Court.
In view of the aforesaid, since a short question is involved in this petition, let the matter be posted in the week commencing 02.03.2022 for further consideration.
