By this petition preferred under Article 227 of the Constitution of India the petitioner has prayed for a direction to the executing court for expeditious disposal of the execution case filed by him.
Contention of the learned counsel for the petitioner is that the eviction decree passed in favour of the petitioner has been affirmed by this Court vide
judgment dated 10-12-2020 in FA No. 1310/2013. Thereafter, the petitioner has initiated execution proceedings before the Executing Court, but it is not proceeding with the same in an expeditious manner, and is rather treating the same akin to any other proceedings.
In view of the submission of the learned counsel for the petitioner I deem it fit and proper to direct the Executing Court to deal with the execution proceedings initiated before it by the petitioner in an expeditious manner and to conclude the same as expeditiously as possible without granting any un-necessary adjournment to the parties.
With the aforesaid, the petition stands disposed off. Certified copy as per rules.
