Learned counsel for the petitioner in support of his contentions has placed reliance upon the judgments of the Hon'ble Apex Court in the matters of State Bank of India and others vs. P. Soupramaniane 2019 (18) SCC 135 , Avtar Singh vs. Union of India and Others 2016 (8) SCC 471 and State of Madhya
Pradesh vs. Hazarilal 2008 (3) SCC 273. However, it is seen that those cases are primarily with respect to removal/termination in view of false information having been given by the employee.
Learned Counsel has not addressed this Court in view of the decision of Full Bench in case of Ashutosh Pawar vs. High Court of M.P. and another reported in 2018 (2) M.P.L.J. 419 as he was directed to do by order dated 05.10.2021. It is also seen that the impugned order dated 07.09.2021 has been passed on the basis of the directions contained in Clause 6-II of directions dated 24.07.2018 of the State Government which are not on record. The petitioner is
directed to place the same on record within a period of two weeks.
