Shri Vivek Patwa, learned counsel for the appellant.
He is heard on I.A. No.362 of 2022, which is an application for
ignoring the defect pointed out by the office.
Learned counsel submits that in the impugned judgment and decree
passed by the Lower Appellate Court liability of Rs.52,000/- only has been
imposed upon the present appellant who is defendant No.5. Thus the appeal
has been valued at Rs.52,000/- and appropriate Court fees has been paid
thereupon. The liability for payment of Rs.1 Lakh was imposed by the trial
Court that too against defendants 1 to 4 which has in any case been modified
by the Lower Appellate Court.
Considering the aforesaid, the application [I.A. No.362 of 2022] is
allowed and defects as pointed out by the office are hereby ignored.
Heard on I.A. No.655 of 2020, which is an application under Section 5
of Limitation Act for condonation of delay in filing the appeal.
Issue notice to the respondents on payment of process fee within a
period of two weeks.
List immediately after service of notice upon the respondents.
