Parties through their counsel.

Heard on IA No. 1332/2022 which is an application under Order 23 Rule 3 of Code of Civil Procedure, 1908 for compromise.

Both the parties are present before the Court today for compromise. Therefore, both the parties are directed to appear before the Principal Registrar of this Court at 3:30 pm today for verification of factum of compromise. The Principal Registrar of this court is also directed that after verification of factum of compromise, he shall submit the report along with record before this Court.

Matter shall be taken up at 4:00 pm alongwith connected appeal.

In compliance to the order passed by this court today, both

the parties marked their presence before the Principal Registrar of this Court and Principal Registrar has recorded his satisfaction in respect of compromise petition jointly filed by the parties under Order 23 Rule 3 of the Code of Civil Procedure.

The Principal Registrar categorically stated that both the parties have voluntarily and without any coercion or fraud entered into the compromise in respect of land in question, which appears to be lawful.

Identity of both the parties have also been verified by Principal Registrar in presence of their respective counsels. The following are the terms and conditions of the compromise:-

In the light of the aforesaid terms and condition of the compromise, IA No. 1332/2022 stands allowed. As a consequence thereof, the impugned judgment and decree dated 9.5.2018 passed by 2nd Additional District Judge Ujjain in civil suit No. 32A/2013 is hereby set aside.

The present first appeal is accordingly allowed. Let a decree be drawn accordingly on the basis of the terms and conditions of the

compromise arrived at between the parties. The compromise petition should be treated as part of decree.
