Jabalpur, Dated : 29-10-2021 Shri J. Tripathi, learned counsel for the petitioner. Issue notice on payment of PF within seven days by RAD mode, failing which this petition shall stand dismissed automatically without further reference to the bench.

Heard on IA No. 6023/21, an application seeking interim relief in the

matter to stay the proceedings of Case No. 72/20-21 pending before the Collector, Sidhi.

It is pointed out that with respect to mutation order passed by the Tahsildar, an appeal which is pending for considerations against the same order dated 10.3.2021 suo moto proceeding has been initiated by the Collector. The appeal is still pending before the SDO and stay has been granted by the learned SDO, therefore, when the appeal is pending before the competent authority, i.e. the SDO, the Collector was having no rights to take up the matter in suo moto proceeding. It is pointed out that the matter is

kept for final judgment on 01.11.2021 before the Collector. He has prayed for grant of interim relief in the facts and circumstances of the case.

Considering the aforesaid, the further proceeding with respect to case pending before the Collector, i.e. Case No. 72/20-21 is directed to be stayed till the next date of hearing.

List the case in the week commencing 29th of November 2021. C c as per rules.
