Record of the courts below be requisitioned. Also heard on I.A.No. 27195/2021 for suspension of sentence. This Criminal Revision is preferred against the judgment of conviction u/s 337, 338 and 304-A of IPC and sentence to undergo 3 month RI, 6 months RI and 2 years RI with fine of Rs.500/- on each count with default stipulation passed by II ASJ, Mandsaur in Cr.Appeal No. 44/2020 on 27.9.2021 by which learned Judge has affirmed the judgment passed by JMFC, Mandsaur in cr.case No. RCT 1401-000382/2012.

Learned counsel for applicant submits that applicant has already surrendered and fine amount has been deposited.

Considering the nature of allegations, period of sentence coupled with the fact that final hearing of revision is not possible in near future, I deem it proper to suspend the remaining jail sentence of applicant-Vikas.

Accordingly, IA No.27195/2021 is allowed. The substantive jail sentence of applicant is suspended subject to his furnishing a personal bond in the sum of Rs.50,000/-(Rupees Fifty Thousand) with one local solvent surety in the like amount to the satisfaction of the trial Court for his appearance before the concerned trial Court on 22.12.2021 and on all other subsequent dates as may be fixed by the trial court in this behalf.

IA No.27195/2021 stands disposed of. Certified copy as per Rules
